The General Data Protection Regulation (GDPR) is a regulation by which the European Parliament, the European Council and the European Commission intend to strengthen and unify data protection for individuals within the European Union. It also addresses export of personal data outside the European Union.

The primary objectives of the GDPR:

  • To give citizens back the control of their personal data.
  • To simplify the regulatory environment for international business by unifying the regulation within the EU.

The regulation was adopted on 27 April 2016. It enters into application 25 May 2018 after a two-year transition period.

To which organizations or data subjects does the regulation apply?

The regulation applies if the organization, SMB or Enterprise, or the data subject (person) is based in the EU. Furthermore the regulation also applies to organizations based outside the European Union if they process personal data of EU residents.

According to the European Commission "personal data is any information relating to an individual, whether it relates to his or her private, professional or public life. It can be anything from a name, a photo, an email address, bank details, posts on social networking websites, medical information, or a computer’s IP address."
